Frequently asked questions from residents about the Omgevingswet

We can imagine that you still have questions about the new Omgevingswet and what will change in practice. Therefore, we have listed many questions and answers for you as a resident.

What permits are covered by the Omgevingswet?

All spatial changes. Think, for example, of building a house or business premises, cutting down trees or installing an air conditioner. But also changing the use of a building: a store that becomes a catering establishment, for example. The law also covers causing noise or odor and the use of hazardous substances.

What permits are not covered by the Omgevingswet?

You may also need a permit for other activities. Think of a parking permit, collection or commercial alcohol serving. These are not covered by the Omgevingswet. Check this page for more information.

When do I need a permit?

Follow the roadmap to check whether you can build permit-free or need to apply for an environmental permit at nl. You can do the Permit Check here. Not all building plans require a permit. This may show that your plan does not require a permit, requires one or more permits, or needs to be reported.

Do I have to pay for a permit application?

The fees for processing an application for an environmental permit for a project are as follows:

You may owe fees for several activities or acts that make up your application. These fees are added together. Fees will also be charged for any additional tests that may need to be performed in connection with the application. You can find the fee rates on the information page on environmental permits

What costs should I consider?

  1. Fees for the spatial permit (an environmental plan activity (OPA) may comply or not comply with the rules in the environmental plan) to be requested from the municipality.
     
  2. Fees for a technical permit for construction works with more risks for society (Building Quality Assurance Act, Wkb consequence class 2 or 3). For Wkb consequence class 1, a (free) notification requirement to the Municipality of Voorne aan Zee is mandatory. For more information on the Wkb, see the Wkb information page.
     
  3. Fees for additional testing required.
     
  4. Costs for (technical) building plan review and (technical) building supervision. For this you hire a quality assurance company. This is not done through the municipality. More information can be found on the information page Wkb.
     
  5. Finally, you should consider any costs of participation.

Will I be allowed to build my own soon?

That is certainly allowed. That does not change. What does make a difference: for new construction that falls under consequence class 1 according to the Wkb, in most cases the municipality no longer looks at the technical safety and quality. Only in exceptional cases, such as for national monuments. From now on, you usually arrange the technical safety and quality of your building yourself with an external quality assurance company. The quality assurance officer will look at the construction drawings and the execution of the work. The municipality remains responsible for the safety of the surroundings in case of calamities.

Do I need a demolition notification or permit?

For all structures (both permit-exempt and permit-required), a demolition notification must be submitted if more than 10 m3 of demolition waste and/or asbestos is released. This will not change. Look for more information on this page.

Do I need a permit for fire safety?

As of 1-1-2024, the permit requirement for fire-safe use expired. The Building Works Decree for the Living Environment (Bbl) does require a use notification in certain cases before a building can be put into use. This has to do with fire safety. This obligation depends on the function of use of the building, or on the number of persons who will be staying there at the same time. You submit the notification to the municipality. Where do I find all the rules about what I can and cannot build?

You should check your plans through the Permit Check at nl. There, as of January 2024, the applicable rules for your structure have been incorporated. These rules are also defined in the Environment Plan. You can find the Environment Plan through Rules on the Map at nl.

What if my initiative does not meet the rules?

We are happy to consult with you. Perhaps your plan can be modified in such a way that it does comply. This can be investigated by submitting a preliminary consultation. More information about submitting a preliminary consultation can be found here. Are you having trouble with your application? In some cases it is best to submit a pre-consultation. For questions about this, please contact the municipality via 14 0181 during the telephone consultation hour building/construction on working days from 08.30 to 16.00 hours.

What is the benefit of submitting a pre-consultation?

Sometimes your initiative may require other things you didn't think of. Consult with the municipality about your plans in advance so that you are not confronted with surprises. You can do this by submitting a preliminary consultation. The advice on a preliminary consultation also gives you more insight into the chances for your initiative if, for example, it conflicts with the environmental plan. This ultimately speeds up the permit application procedure because you know exactly what your plan must meet. Even if a plan is not feasible, this will become clear, saving you fees for an application.
