Demolition notification building or part building

You usually do not need a permit to demolish. However, you often need to report the demolition to the municipality.

You file a demolition notification in the following cases:

  • demolition will release 10 m3 or more of waste
  • during demolition you remove asbestos

Demolition notification and environmental permit

You will also need an environmental permit in the following cases:

  • demolition work on a recognized monument
  • demolition work on a building in a protected town or villagescape
  • demolition in violation of zoning plan

What should I do?

Doing demolition notification

You do the demolition notification through the Omgevingsloket online. Use your DigiD. Companies do the notification with eHerkenning.

If you also need an environmental permit, you can also submit an application for this via Omgevingsloket online. You do this at the same time as the demolition notification.

Make the notification at least 4 weeks before you want to start. In the following cases, make the notification no later than 5 working days in advance:

  • As a resident, you remove adherent asbestos up to a maximum of 35 m² per plot.
  • Your company performs repair or mutation maintenance work on a part of the building containing asbestos. This only applies if during those 4 weeks the building is unnecessarily unoccupied or interfering with its use.
  • The landlord performs maintenance work.

Asbestos

If you are not sure if a particular material contains asbestos, you can check the Asbestos Roadmap to get an idea of what materials may contain asbestos. Only a certified company may examine whether asbestos is present. A list of certified companies can be found at Ascert.

After the demolition notification

  • The municipality will send you an acknowledgement of receipt of the demolition notification.
  • If your report is not complete, you will be notified and must file a new report.
  • If your report is indeed complete, the municipality may set Requirements for the demolition work. You must comply with these Requirements .

Report start and end of work

  • Before starting demolition work, notify the municipality. Do this at least 2 working days in advance.
  • When you have finished the work, also report it to the municipality. Do this no later than the first working day after you have finished the work.

What do I need?

Information accompanying the demolition notification

  • name and address owner of structure to be demolished
  • name and address performer of work
  • address, cadastral number and type of structure
  • the dates and times you will demolish
  • how you are going to demolish
  • details of the waste and how you will dispose of it

Enclose reports with demolition notification

With the demolition notification, you may also need to include one or more reports. For example:

  • (if you expect to release asbestos) an asbestos inventory report from a certified asbestos inventory company
  • A demolition safety plan: for safety at the demolition site
  • An acoustic survey report: to reduce noise pollution
  • a report of a vibration study: to reduce nuisance from vibration

Note! You must always include an asbestos inventory report if it involves a building built before 1994.

Important preparation

Research on protected species

Before you may demolish a home or other building, you must first investigate to make sure that no protected species are present. For example, swifts or house sparrows may be nesting under your roof, or bats may be present in your home's cavity wall or in building cracks. Barns may contain nesting sites for owls or swallows. These nesting sites and habitats are protected year-round under the Omgevingswet. Removing them is therefore an offense. To exclude their presence, you should have a nature assessment or quickscan carried out by an ecological expert. You can send this report along with the demolition notification or environmental permit application. 

If habitats of protected species are present, you will need an exemption. If you need an environmental permit, you can arrange this through the municipality. Otherwise, you must apply for a separate exemption from the Omgevingsdienst Haaglanden.

Area-based Exemption for former municipality of Hellevoetsluis (Hellevoetsluis, Oudenhoorn or Nieuwenhoorn)

For the built-up areas of the nuclei of the former municipality of Hellevoetsluis (Hellevoetsluis, Oudenhoorn or Nieuwenhoorn), the municipality has an area-specific exemption for bats, house sparrows and swifts. If the building you want to demolish is located there, you can use the Flora Fauna check website . Here you can check if the building you want to demolish is suitable for bats, house sparrows and swifts and if they are present. You can then also use this exemption so you do not have to do any research yourself. However, you must meet the Requirements and create new habitats in the new building. More information can be obtained from the municipality.

How long does it take?

Once you have filed your demolition notification, you can begin demolition after 4 weeks. This is only allowed if you have not received notice that your notification is not in order.

If you filed a demolition notification for work that you were required to notify no later than 5 business days in advance, you can begin demolition after 5 business days. Unless you have been notified that your notification is not complete. Then you must submit a new notification. The deadline will then begin again.

If you have also applied for an environmental permit, the following applies:

  • You will be notified within 8 weeks whether you will receive the permit. This period can be extended by 6 weeks.
  • If the municipality does not decide within this period, you will automatically receive the permit. (by operation of law).
  • For complex applications, you will be notified within 26 weeks. This period can be extended once by 6 weeks. You will not receive the permit automatically.
