Are you going to build or remodel? Cut down a tree? Change the use of a building or site? Often you need an environmental permit (permission) for this because it affects the environment. Together we have made agreements about what is and what is not possible. Much of this can be found in the environmental plan. With the environmental permit, the municipality checks whether your application (initiative) fits into these agreements.

Sometimes your initiative may require other things you didn't think of. Consult with the municipality about your plans in advance so that you are not confronted with surprises. You can do this by submitting a preliminary consultation. The advice on a preliminary consultation also gives you more insight into the chances for your initiative if, for example, it conflicts with the environmental plan. For simple questions, you can request information every working day from 8:30 a.m. to 4 p.m. by calling 14 0181.  

How does it work?

For example, you may need an environmental permit for the following activities:

  • Building, remodeling or demolishing a structure (such as a house).
  • Demolishing a structure in protected town or villagescape.
  • Altering a municipal or provincial monument, or remodeling or demolishing a monument.
  • Building a road.
  • Making an exit (or driveway) on the municipal or provincial road.
  • Attaching an alarm system to an immovable property (such as a factory, office or home).
  • Making and displaying commercial advertising (such as a billboard) or allowing it as an owner.
  • Cutting down a tree or felling a timber stand.

What should I do?

In the Omgevingsloket you can do a permit check via the website omgevingswet overheid. You will then see whether or not you need to apply for an environmental permit or whether you need to file a notification, for example. After the check, you can submit your application to the municipality. You can do this by submitting an application via the Omgevingsloket.

Pre-consultation

Do you want to submit a plan to the municipality? Then we are happy to look at the front end with you. This is possible for both simple and extensive complex plans. It depends on the complexity of the plan in what way we can think along with you. Simple plans can be handled more quickly. In this way we look with you and indicate what you should pay attention to in your application. Complex plans are assessed via Intake and Environmental Table in which we assess the desirability and feasibility of a plan as a whole. Objection and appeal

If you disagree with the decision on your permit application, you may file an objection with the municipality. Submit your objection within 6 weeks of the announcement of the decision. After that, if the municipality does not rule in your favor, you can appeal to the administrative court.

A different procedure applies to very complex applications. The municipality makes the draft decision on the environmental permit available for inspection. Within 6 weeks after it is made available for inspection, anyone can submit an opinion. An opinion must explain why a person does not agree with the decision. After the decision has been made, interested parties can appeal to the court within 6 weeks after publication. You are an interested party in any case if you have submitted a timely opinion on the draft decision. There may be several interested parties who can appeal to the court.

How long does it take?

The municipality normally decides on your application within 8 weeks of receipt. This period can be extended once by 6 weeks. If the municipality does not decide on an application in time, you can give the municipality notice of default. If the municipality still does not make a timely decision in response to the notice of default, an appeal for a late decision can be filed with the court. In exceptional cases, a longer decision period applies. If this is the case, the municipality will inform you of this after processing your application.
