Preferential right of the municipality

Preferential right means that the municipality is the first to purchase a property. If you want to sell your home, building or land on which a preferential right applies, you must first offer your property for sale to the municipality. The municipality then has the right to the first purchase. Other authorities can also have a preferential right.

What should I do?

  • You must notify the municipality that you wish to sell your property. You can do this by sending a registered letter to the Municipal Executive. Please include the cadastral designations and square footage.
  • The municipality must let you know within 6 weeks whether they want to buy. If the municipality does not let you know within those 6 weeks, you may sell freely for up to 3 years after that.
  • If the municipality does not want to buy, you may sell your property to someone else once up to 3 years after this decision.
  • If you reach an agreement with the municipality, you will then enter into a purchase contract with the municipality.
