Permit-free construction

The new Omgevingswet allows you to build certain structures without a permit. Does your structure meet the requirements? Then a permit is not required. Do you have any questions or is your structure near a monument or protected town or village view? Please contact the municipality.

Dormers

If your dormer meets the following requirements, you may build it without a permit. 

Where may the dormer be located?

The dormer may only be on the rear roof plane or on a side roof plane that does not face a public area.

Dormer requirements.

  • The dormer should have a flat roof.
  • The dormer may not be higher than 1.75 meters measured from the base of the dormer.
  • Distance to the roof:
    • The bottom of the dormer should be between 0.5 meters and 1 meter above the eaves.
    • The top of the dormer must remain more than 0.5 meters below the roof ridge.
    • The dormer must be more than 0.5 meters from the sides of the roof plane.

Permit-free restrictions due to cultural heritage

  • The dormer is built on, on or near a (pre-protected) monument. This applies to municipal, provincial and national monuments.
  • The roof plane on which the dormer is placed is located in a location that has been assigned the function indication "national protected town and village view" in the environmental plan. In addition, the dormer is placed in the side roof plane or in the rear roof plane facing public access.

Air conditioning/heat pumps

If your air conditioner meets the following requirements, you may build it without a permit.

Where may the air conditioner/heat pump be located?

You may place an air conditioner or heat pump in the front or back yard.

Requirements

  • The structure must not exceed 1 meter in height and must stand on the ground.
  • The area of the structure must not exceed 2 m².
  • Maximum sound level of 40 decibels.

Permit-free restrictions due to cultural heritage

The following situations limit the options for permit-free construction of an air conditioner/heat pump due to cultural heritage:

  • The air conditioner/heat pump is built on, on or near a (pre-protected) monument. This applies to municipal, provincial and national monuments.
  • The location where the air conditioner/heat pump will be installed is located on a site that has been given the function designation "national protected town and village view" in the environmental plan.

Frames or frame infill

If your window frame or frame infill meets these requirements, you may build it without a permit.

Where may the frame or infill of the frame be located?

  • In or on the rear façade of a building...,
  • In or on the side wall of a main building, but only if the side wall does not face a public area.
  • Window frame or infill may also be installed:
    • In or on the facade of an accessory structure, if the facade is in a rear yard area.

Permit-free restrictions due to cultural heritage

In the following situations, the possibilities for making or changing a window frame or infill permit-free due to cultural heritage are limited:

  • The frame is located on, on or near a (pre-protected) monument. This applies to municipal, provincial and national monuments.
  • The window frame is placed in a location to which the environmental plan has given the function designation "state-protected town and village view.

Restrictions on permit-free due to privacy

In the following situations, the options for making or changing a window frame or infill permit-free because of privacy are limited:

  • The window frame or frame infill is placed within two meters of the property line facing your neighbors. If you place a window frame or window infill within two meters of the property line, it must be blinded. 
  • With your neighbors' permission, the window frame and frame infill can be unblinded.
