Temporary rental vacant property

Do you want to temporarily rent out a house or office because it is vacant? Then you need a vacancy permit from the municipality.

The municipality grants the permit for up to 2 years the first time. After that, you can apply to renew the permit. In total, you can never have a vacancy permit for more than 5 years.

The permit states what the maximum rent is. The municipality determines this rent according to the point system that also applies to ordinary rental houses.

How does it work?

You can apply for the vacancy permit for the following vacant buildings:

  • A building that is not built for residential purposes, such as an office, school or group housing building
  • a property that is for sale and has never been occupied
  • a property for sale in which the owner has lived during the 12 months before it became vacant
  • a property that is for sale and has not been lived in for more than 3 years in 10 years
  • A rental property that will be demolished or renovated

If you receive the permit from the municipality, it will state a maximum rent. The municipality sets the rent based on the point system that also applies to ordinary rental houses.

What should I do?

  • You fill out the form from the Rijksoverheid. You can find the form under "Apply.
  • Send the completed form to the municipality.

What do I need?

On the application form, please indicate the following:

  • your personal data
  • details of the building or property in which you wish to rent space
  • data of the tenant
  • description of the space you want to rent out
  • the reason for your request
  • Whether you have a permit under the Housing Act, such as an eviction permit or division permit

How long does it take?

The municipality grants the permit for up to 2 years the first time. After that, you can renew the permit each time for a maximum of 1 year. In total, you will never receive the permit for more than 5 years.

Additional information

The municipality may determine that the tenant of the property you want to rent out temporarily also needs a housing permit.

Have you obtained a vacancy permit for temporary rental? Then the normal rent protection rules usually do not apply. However, the rules for temporary rental from the vacancy law do apply. These include:

  • The tenant has no rent protection when the lease ends.
  • The lease is for a minimum of 6 months.
  • The tenant has a minimum notice period of 1 month.
  • The landlord has a notice period of at least 3 months.
  • The lease ends when the vacancy permit expires.
