Room Rental
As of August 30, 2024, the zoning plan "Umbrella Review of Room Rental Voorne aan Zee" will apply to the entire territory of the municipality. Below you will find information about the rules in this zoning plan.
Where is room rental regulated?
An elaboration for residential uses can be found in zoning ordinances and in the adopted umbrella review. These can be found on the website Omgevingswet under plan identification number NL.IMRO.1992.umbrellaplanwonen-0130.
What does the zoning plan "Umbrella Review Room Rental Voorne aan Zee" entail?
An umbrella zoning ordinance is a zoning ordinance that overlays the applicable zoning currently in effect within the designated area. The umbrella zoning plan for housing and room rentals does not allow room rentals within the "housing" zoning. This applies to the entire territory of the Municipality of Voorne aan Zee.
"Dwelling" refers to the use of a dwelling for housing no more than one household. When there is one household can vary. A family or a relative may be considered one household. An affective relationship also constitutes one household. It does not include migrant workers, students or a group of friends.
When is room rental?
In short, a room rental occurs when a non-self-contained living space is rented out.
This involves the (partial) letting of a dwelling through rooming out, where rooms do not constitute independent living quarters due to the lack of essential facilities such as their own cooking and/or washing facilities and/or toilet.
Based on the zoning plan, room rentals are not allowed. Exceptions to this are cases where room rental is through the municipal housing company or authorized institution as referred to in the Housing Act.
Why is room rental regulated?
Previously, the terms "living," "dwelling" and "household" were not defined in the same way in zoning plans. In addition, Hellevoetsluis already had a preparatory decision as of July 7, 2022, Brielle had an umbrella zoning plan, and Westvoorne had no rules on room rentals. By establishing these terms in the umbrella zoning plan, the terms are the same in every zoning plan of the former municipalities.
In addition, buying up relatively cheap homes for rent has the effect that first-time buyers and young families have no or less chance of buying a home. In this way, homes are withdrawn from the regular housing market where there is scarcity.
Who does this zoning plan apply to?
This umbrella zoning plan applies to anyone and will primarily affect owners/lessors of residential properties.
This plan applies to destinations of the Municipality of Voorne aan Zee that permit residential use. Living refers to the use of a dwelling for housing no more than one household. When there is one household can vary from case to case. A family and relatives can be considered one household and an affective relationship also constitutes one household, but migrant workers, students or a group of friends are not included.
Former Brielle municipality - room rentals before and after Sept. 30, 2020
Room rental is not allowed for new situations created on or after September 30, 2020 within the territory of former municipality of Brielle. As of this date, the preparatory decree "umbrella zoning plan: addition of terms to prevent undesirable residential use" came into effect. This decree is the predecessor of the previous umbrella zoning plan and also did not allow living in a dwelling by more than one household. Then the preparatory decree "room rental and residential division" fell over this. Finally, the adopted zoning plan "Umbrella Review of Room Rental Voorne aan Zee" is now in force.
For situations involving room rentals prior to September 30, 2020 within the former municipality of Brielle, this is in principle allowed, provided that the room rental has not been interrupted for more than one year from the time the umbrella zoning plan takes effect on December 17, 2021. Transitional law may apply to these existing cases.
Former Hellevoetsluis municipality - room rentals before and after July 7, 2022
Room rental is not allowed for new situations created on or after July 7, 2022 within the territory of the former municipality of Hellevoetsluis. As of this date, the previous preparatory decree 'residential division and room rental' came into effect. This decree is the predecessor of the current preparatory decree and also did not allow living in a dwelling by more than one household. Subsequently, the preparatory decree "room rental and house division" fell over this. Finally, the adopted zoning plan "Umbrella Review of Room Rental Voorne aan Zee" is now in force.
For situations involving room rentals prior to July 7, 2022 within the former municipality of Hellevoetsluis, this is in principle allowed, provided that the room rental has not been interrupted for more than one year from the time the umbrella zoning plan comes into effect on August 30, 2024. Transitional law may apply to these existing cases.
Former Westvoorne municipality - room rentals before and after July 6, 2023
Room rental is not allowed for new situations created on or after July 6, 2023 within the territory of the former municipality of Westvoorne. As of this date, the preparatory decree 'residential division and room letting' came into effect. This decree is the predecessor of the umbrella zoning plan currently in force and also did not allow living in a dwelling by more than one household.
For situations involving room rentals from before July 6, 2023 within the former municipality of Westvoorne, this is in principle allowed, provided that the room rental has not been interrupted for more than one year from the time the umbrella zoning plan takes effect on August 30, 2024. Transitional law may apply to these existing cases.
Where can I report room rentals?
You may notice that a property near your own home is being rented out by rooms. If you want to take action against this, you can report this to the municipality. You can do this by e-mail via nl In your report, please include both the address of the house that is being rented out by rooms and your own address, the number of people living in the house and your contact information.
Note! Your notification must involve cases as listed under the heading "Who does the preparatory decision apply to?".
Nuisance
If you experience a nuisance, please report it to the police. You can do this through your neighborhood police officer or call the police at 0900-8844.
I have reported to the municipality a property that is being used for room rentals. What happens to my notification then?
If you have reported a property that is being rented out room by room, you will receive a confirmation of receipt of your report. After that, a basic registration of persons investigation and a Building and Housing Inspection will take place and contact will be made with the owner/landlord. On this basis it will be determined whether the observed situation is in violation of the applicable laws and regulations. You will be informed of the outcome of the investigation.
