When it comes to supplies or services, the municipality in principle applies its own purchasing conditions. 

For specific contracts, the municipality may also apply other procurement requirements more appropriate to the nature of the contract. For example, there are alternative Requirements for ICT services, outdoor work and engineering services.

Assignments may only be given by officials authorized to do so. Whether a principal is authorized is included in the General Mandate Decree of the Municipality of Voorne aan Zee. As a contractor, you have your own responsibility to check whether the principal is actually authorized.

Procurement Complaints Procedure 

The Municipality of Voorne aan Zee operates a Procurement Complaints Procedure for parties who have a complaint about the procurement process.

When is there a complaint in a tender? 

A complaint is a written notification from an entrepreneur with an interest in the procurement in which this entrepreneur states the points on which he does not agree with the procurement or a part thereof, giving reasons. Complaints should relate to aspects of procurement that fall within the scope of the 2012 Procurement Act. Procurement may be European or National. National tenders include (multiple) negotiated contracts. Complaints can raise the issue that a particular act or omission in a specific procurement violates statutory provisions or other regulations applicable to that procurement. Complaints can also address actions that violate one or more of the principles of transparency, non-discrimination, equal treatment and proportionality applicable to procurement. Complaints cannot be about the procurement policy in general of the Municipality of Voorne aan Zee. 

When can a complaint be filed? 

Not every question from an entrepreneur in a procurement procedure needs to result in a complaint, and not every complaint needs to lead to the completion of the standard for complaint handling. Questions and requests aimed at clarifying aspects of the procurement procedure must be submitted by the entrepreneur to the Municipality of Voorne aan Zee in a timely manner, so that the question can be answered in the Note of Information of the relevant procurement procedure. This also applies to a request to make a non-substantial change to the tender documents. If the entrepreneur continues to disagree with the response in the Nota van Inlichtingen (or, if applicable, in the individual information) he can file a complaint with the Municipality of Voorne aan Zee . This also applies if a response is not forthcoming. The entrepreneur must submit his complaint as soon as possible so that the complaint can still be dealt with within the current tender. If a complaint cannot be dealt with within the current tender, the opinion on the complaint can only be used as a lesson for future tenders. A complaint does not have a suspensive effect on the procurement procedure. The right to file a complaint does not affect the entrepreneur's right to initiate legal proceedings. If the subject of the complaint is also the subject of legal proceedings, the handling of the complaint will be suspended until after the court's ruling. 

Who can file a complaint? 

Only entrepreneurs who have an interest in a specific procurement procedure of the Municipality of Voorne aan Zee can file a complaint. Interested parties include entrepreneurs who have a direct interest in acquiring the public contract in question. The following categories of interested parties can be distinguished: 

  • interested entrepreneurs; 
  • (potential) bidders and candidates; 
  • subcontractors of (potential) bidders and candidates; 
  • industry associations and industry-related entrepreneurial advisory centers. 

Subcontractors can file a complaint to the extent that they are not complaining about the relationship main contractor versus subcontractor and vice versa. Anonymous complaints are not possible. However, an industry organization may, in its own capacity, submit as a complaint objections relating to a specific procurement procedure, which are felt by one or more entrepreneurs of the industry. 

Procedure 

  1. Complaints can only be submitted in writing (by mail or e-mail), stating the name and address of the complaining entrepreneur, the date and indication of the tender. The written complaint must also clearly state what is being complained about and how, according to the entrepreneur, the bottleneck could be remedied. In writing: Gemeente Voorne aan Zee; t.a.v.   2. The complaint hotline will acknowledge receipt of the complaint by return.
  3. The complaint hotline then investigates, possibly on the basis of data provided by the entrepreneur and its own additional information, whether the complaint is justified. The complaint hotline begins this investigation as soon as possible, continues it energetically and takes into account the planning of the procurement procedure. 
  4. If, after the investigation by the complaints hotline, it is concluded that the complaint is justified or partially justified and corrective and/or preventive measures need to be taken, this will be communicated in writing to the relevant entrepreneur as soon as possible. The other (potential) bidders/tenderers are also informed. Depending on the stage in the tender procedure, the measures may be communicated by the contact person of the tender to the parties involved in the tender at the same time as the complainant receives the message. This is to avoid favoritism between parties. 
  5. If after the investigation it is concluded that the complaint is not justified, the complaint will be rejected with reasons and the entrepreneur will receive written notice of this. 
  6. The complaints hotline may, at the request of the entrepreneur or on its own initiative, propose that the complaint, before being decided on by the complaints hotline, be submitted to the national Commission of Procurement Experts for mediation or advice. 
  7. As a result of the decision or failure to make a timely decision, an entrepreneur may refer the complaint to the national Commission of Procurement Experts.
