Restraining order for domestic violence

How does it work?

The mayor may impose a restraining order on the adult person who commits domestic violence or creates a serious threat of domestic violence.

The restraining order means that the perpetrator of domestic violence:

  • Immediately must leave the property.
  • Not allowed to contact those in the household, such as the partner and children.
  • Not allowed in the house or near the house.
  • Let the mayor know how and where he can be reached during the restraining order.

Imposition of temporary restraining order

Victims, witnesses, neighbors, friends, family can report or report domestic violence to the police. The following steps are followed when imposing a restraining order:

  1. The police assess the situation at the scene of the domestic violence;
  2. Based on the facts and circumstances, the mayor imposes a restraining order on the perpetrator of domestic violence. In some cases, an assistant district attorney executes this authority;
  3. The restraining order is valid for 10 days;
  4. During the 10 days, assistance is initiated for all involved;
  5. After 10 days, the mayor extends the restraining order for up to 4 weeks if the threat of domestic violence still exists;
  6. The restraining order can be appealed to the court.

An evictee who fails to comply with the restraining order can face up to 2 years in prison or community service.

Revocation of restraining order 

The mayor can revoke the restraining order at any time. Reasons for revocation may include:

  • The threat to the victim is gone.
  • The evictee accepted an offer of assistance.
