Holding municipality liable for damages

For what damage?

You can hold the municipality liable for damages you suffer due to the municipality's fault or negligence. There are two types of damages for which you can seek compensation:

  • Damages you have suffered as a result of municipal acts or omissions.
  • Damage you incur because the municipality does not properly maintain roads, squares, public green spaces and structures.

     

What should I do?

You can only hold the municipality liable in writing. This can be done by letter or via DigID

If you hold the municipality liable in a letter, you must clearly describe the event that caused the damage and what the damage is. Please also clearly indicate when it occurred and the reason why you believe the damage should be compensated by the municipality. You can send this letter to:

In addition, the letter must include at least the following information:

  • Personal data (including bank account number);
  • Details of the (facts of the) damage (circumstances and location);
  • Why you believe the municipality is liable;
  • The substantiation of your claim (invoices and photos).  

How long does it take?

You will receive confirmation of receipt as soon as possible. The time frame for handling your liability claim depends on the type of damage.
