General Requirements and house rules accommodations

Have you rented a space at one of our sports or cultural facilities and received a confirmation? If so, our General Requirements House Rules for the Use of Sports and Cultural Facilities Voorne aan Zee apply. These Requirements house rules are revised each season.

General Requirements the Opening of Sports and Cultural Facilities

The Municipal Executive, represented by the facilities manager, grants the use of the following facilities by confirming the reservation (the reservation confirmation) (hereinafter referred to as the “grantor”):

  • DukdalfBRES Sports and Culture Center – Brielle
  • MFC De Meander – Oostvoorne
  • CC De Man – Oostvoorne
  • MFC ’t Dijckhuis – Vierpolders
  • MFC De Merel – Rockanje
  • Reede Gymnasium – Brielle (key rental)
  • Tromp Gymnasium – Brielle (key rental)

The occupant is the person who uses the accommodations listed above, and acceptance of the General Requirements the house rules and code of conduct is a prerequisite.

Key rental means that no staff from the provider will be present. The user will have a key for the reserved times.

A participant is someone who takes part in the activities offered by the provider or the user.

General provisions

1.1 The lessor may declare to an association that, for the purpose of playing matches established by or on behalf of national sports federations, that association has priority for the shared use of facilities over their use for other purposes. 
1.2 The lessor reserves the right at all times to dispose of the facility or to temporarily grant its use to others, or to limit the agreed-upon use to a smaller portion, without the lessee being entitled to claim compensation for any damages, however named.
1.3 If such a measure is decided upon, the lessee shall be notified of this, if possible, at least 21 days prior to the effective date. The usage fee will then be reduced proportionally by an amount to be determined by the lessor.
1.4 In all cases not provided for in the General Requirements the house and conduct rules, the lessor shall decide.
1.5 The rates are set forth in a resolution on rates for sports and cultural facilities. 
1.6 The applicable rates and General Requirements published on the websites.
1.7 The Lessor reserves the right to amend these General Requirements .


2. Liability, Costs, and Damages

2.1 The operator is never liable for any damage suffered by the participant or the parent/guardian during participation in the activity, unless there is intent or gross negligence on the part of the operator.
2.2 If the lessor is liable, its liability is in any case limited to the amount and the cases for which the lessor’s liability insurance pays out.
2.3 The lessee is liable for all damage caused during the use of the accommodation through his or her own actions.
2.4 The occupant is obligated to report all damage immediately to the provider. By occupying the accommodation and using the inventory therein, the occupant is deemed to have accepted them in the condition in which they are found at the time of occupancy. 
2.5 The Lessor shall in no event be held liable for any accidents or consequences of accidents occurring in the accommodation, whether or not resulting from the Lessee’s failure to fulfill its supervision and safety obligations, nor for damage, mix-ups, loss, or theft of property belonging to the user, their members, or persons using the accommodation under the user’s responsibility, or third parties admitted by the user. The user indemnifies the provider against any claims by third parties in this regard.
2.6 The user must be adequately insured against civil liability and must remain insured for the duration of the period agreed upon in the reservation confirmation.
2.7 If the user uses the accommodation with the provider’s consent for events where the nature of the use or the number of participants or spectators/visitors deviates from the regular use for regular (sports) activities, the user is obligated to apply, at their own expense, for all (event) permits and exemptions required for this deviating use.

3. Permits and exemptions

3.1 The Guest is required to determine for themselves whether permits and exemptions are required for the agreed-upon use of the accommodation. Making a reservation for the aforementioned use does not constitute any explicit assurance that the necessary permits and exemptions will actually be granted and/or are complete.
3.2 The user shall provide the lessor with a copy of the aforementioned permits and/or exemptions within two days after they have been granted by the competent authority and in any case five days prior to the start of the event.
3.3 The Lessee is obligated to use the premises in such a way that no action is taken in violation of any law, ordinance, permit, or other government regulations, including (fire) safety standards of the police and fire department. If, with the Lessor’s permission, music is played or sound and/or audiovisual equipment is used, the standards set forth in the Noise Pollution Act may not be exceeded.

4. Reservation Confirmation

4.1 The accommodation may only be used in accordance with the reservation confirmation and exclusively for the accommodation, activities, periods, and times specified in the reservation confirmation.
4.2 If the user uses the accommodation outside the period of use specified in the reservation confirmation, without the lessor’s consent, the user shall owe the lessor a penalty equal to twice the applicable hourly or half-day rate (rounded up to the nearest whole hour).

5. (Payment) obligations 

5.1 The Lessor may deny the Lessee access to the accommodations if, at the time the Lessee wishes to take possession of the accommodations, the Lessee has not yet fulfilled its payment obligations. This does not affect the start date specified in the reservation confirmation or the Lessee’s obligations Requirements the General Requirements .
5.2 If the occupant or the participants admitted by him fail to comply with the obligations under the Requirements Use and/or the house rules, the lessor is authorized to remove them from the accommodation and deny them access to the accommodation. In this case, the user has no claim to any compensation for damages, however named, or to a refund of usage fees already paid. In such cases, the provider may deny the user access to the accommodation for a maximum of one month.

6. Cancellation Policy

6.1 If the reservation is canceled by the guest, the host (Accommodations Team) is required to charge a cancellation fee.
a.    Up to two weeks before the reservation date: 0%.
b. Between 2 weeks and 2 days before the reservation date: 50% of the room rental fee.
c. 1 day before the reservation date: 100% of the room rental fee, staff costs, and other expenses.

7. Supervision

7.1 The User shall ensure that its supervisors are made aware of the established house rules and code of conduct.

8. Safety and Emergencies

8.1 The Lessor shall ensure that the accommodation is properly maintained and complies with the legal requirements applicable to accommodations. The Lessor must ensure that there is an emergency plan for the accommodation and shall inform the Lessee of the contents of this plan. This emergency plan specifies how accidents and emergencies are to be handled and who has which tasks and responsibilities should such emergencies occur.
8.2 The Lessor must ensure that there is an evacuation plan specifying how the premises are to be evacuated in the event of an emergency and which escape routes must be used in such cases.
8.3 The Lessee is obligated to implement the emergency plan and the evacuation plan in the event of an emergency.
8.4 The User is obligated to participate in evacuation drills organized periodically by the Lessor.
8.5 The Lessor shall appoint one or more evacuation coordinators who, in the event of an emergency, will work with the User to ensure the evacuation of the premises in accordance with the evacuation plan and will alert/notify emergency services.
8.6 The Lessor is authorized at all times to interrupt activities during use if, in its judgment, this is necessary for the safety of the Lessee or participants in the relevant activities.
8.7 The Lessor shall ensure the availability of first aid supplies appropriate for the regular use of the premises. Health is Health the proper use of Health ; the Lessor shall ensure the replenishment of used first aid supplies. If the User uses the facility with the Lessor’s permission for (sports) events, where the nature of the use or the number of participants or spectators/visitors deviates from regular use for the purpose of regular sports activities, the user shall ensure the expansion of the existing first aid supplies and, if necessary, provide first aid personnel to the extent required by legal and/or local regulations.
Article 8.7 does not apply to accommodations with key rental.
8.8 If the user uses the accommodation with the lessor’s permission for (sports) events, where the nature of the use or the number of participants or spectators/visitors differs from the regular use for regular sports activities, the user is obligated, in addition to their obligation under Article 3, to draw up a layout plan for the facility tailored to the event, a schedule, and an emergency plan.
8.9 The user shall ensure that the layout plan, the schedule, the emergency plan, and the number of participants referred to in Article 8.8 are submitted to the provider for approval at least five days prior to the commencement of the activity.

9. Swimming pools

Safety Responsibilities of the User
9.1 If the user is an educational institution and the swimming pool is used for school swimming lessons, the user must also comply with the Safe School Swimming Protocol of the Association of Sports and Municipalities.
9.2 If the user uses the facility for swimming lessons and the administration of swimming certificates, the user shall ensure that, in addition to a supervisor, at least one certified swimming instructor is present, who must hold the diplomas or certificates recognized by the National Platform for Swimming Pools | NRZ, including at a minimum the Zwem-ABC instructor (water safety inspector) qualification or comparable, recognized diplomas or certificates. 
Article 7 applies to the aforementioned swimming instructor.

10. Responsibility, Obligations, Prohibitions, and Rules of Conduct for the User

10.1 The occupant is responsible for ensuring that those participating in the activities organized by the occupant use the accommodation for its intended purpose and comply with the house rules and code of conduct set forth in this section that apply to and within the accommodation, and shall supervise them until all occupants have left the accommodation. 
10.2 The user may not allow third parties to use the accommodation reserved by him, either in whole or in part.
10.3 The assembly and disassembly, placement, and/or removal of sports and playground equipment and materials must take place within the agreed-upon usage times.

11. Disputes

11.1 All disputes between the licensor and the licensee shall be governed by Dutch law.

House Rules for the Use of Sports and Cultural Facilities

House Rules: General

1. You agree Health :
a. to use the premises and the inventory and materials therein in an orderly manner, in accordance with their intended purpose and consistent with the purpose for which permission to use them was requested;
b. to leave the premises clean and tidy after each use.

2. You are not permitted to make any changes to the buildings or have any changes made to them.

3. Both the guest and their supervisors must be at least 18 years old to be permitted to use the accommodations.

4. The occupant may not allow third parties to use the occupied space or sublet it to third parties.

5. The lessee may not use the leased space for commercial purposes. The lessee is not permitted to sell products or services within the leased space. Charging admission fees is not permitted unless prior written consent has been granted by the lessor.

6. Hours of Use:
a. Entry into the hall or room is not permitted before the start of the reserved time slot, unless prior permission has been granted by the venue operator;
b. Extending the reserved time slot is not permitted, unless prior permission has been granted by the venue operator.
c.    Extending the period or entering the venue earlier (upon permission and if possible) will be charged.
d. Setup and takedown of (game) materials, decor, furniture, or other items must take place within the agreed-upon period.

7. The lighting and sound systems and/or audiovisual equipment located in the buildings may not be used without the express permission of the lessor. Use of these systems or audiovisual equipment must be arranged in consultation with the lessor and may, in some cases, require the hiring of a specialized company (theater technical services).

8. No (illuminated) advertisements, (brand) logos, signs, announcements, or publications may be displayed without the express permission of the lessor.

9. When live or recorded music is played, the legal limits are not exceeded.

10. Bringing in outside food or beverages is not permitted in any of the accommodations. Food and beverages can be purchased at the bar within the accommodation. Catering for a club or party can be ordered from the property manager via email.

This must be submitted at least 5 business days before the date in question. For buffets, this must be done 2 weeks before the date in question.

11. Smoking is not permitted inside the accommodation. The accommodations adhere to the national smoking policy. Outside, smoking stations have been set up near the various entrances, where you may smoke and dispose of your cigarette butts. Smoking is not permitted at the entrance; this area must always be kept clear.

12 It is prohibited to engage in any activities that cause environmental pollution or may result in damage to the property.

13 It is prohibited to use and/or possess substances that are hazardous to the environment, including those that emit odors, are flammable, or are explosive.

14. The use and/or possession of soft and hard drugs is prohibited.

15 Discriminatory behavior or language and aggression are not permitted.

16. Do not engage in disruptive behavior toward staff, other tenants, or visitors to the premises.

17. Pets are not allowed in the accommodations, with the exception of guide dogs or service dogs for people with physical, visual, hearing, or other cognitive disabilities.

18. Except in the areas designated for that purpose, nothing may be affixed, stapled, nailed, or otherwise attached to the floors, walls, doors, etc. without the manager’s approval.

19. Vehicles may only be parked in the designated parking spaces. Bicycles, mopeds, and other vehicles must be parked in the designated bike racks or parking areas. Vehicles parked in front of the entrance to the accommodations will be towed at the offender’s expense.

Safety:

20. In the event of an emergency, the emergency plan will be activated, and you are required to follow any instructions given by the property’s staff.

21. The operator is responsible for ensuring compliance with the terms and conditions of use. Instructions given by or on behalf of the staff at the accommodations must be followed promptly and without delay.

22. The occupant shall designate one or more individuals who, in emergency situations, will work with the emergency response team member to ensure that the evacuation procedure is carried out correctly.

23. Do not leave items in hallways or in front of emergency exits.

Hygiene:

24. The occupant must report any unsanitary conditions to the staff on duty.

25. The operator shall prevent unnecessary littering and ensure that its members and visitors use the (adjacent) space in an orderly manner.

Accommodation-specific house rules:

Sports halls, squash courts, and gyms

26. In the gyms and sports halls (with the exception of Dijckhuis, De Meander, and De Merel), it is permitted to use the facility for events other than sports without covering the floor with adequate protection. This is entirely at the user’s own risk, and any damage to the floor will at all times be the responsibility of the user. If the floor is not covered, pets and stiletto heels are prohibited in the hall. The manager will inspect the floor for any damage prior to and after the event.

27. The user may not move or extend the bleachers in the sports hall under any circumstances; this must be agreed upon in advance with the facility operator. 

28. Glassware, tableware, and food are not permitted in the sports halls, gyms, and swimming pool.

29. It is not permitted to enter the sports floors wearing shoes that have been worn outside the sports facility or that leave marks on these floors (with the exception of spectators seated in the stands or outside the playing fields).

30. The floors of the gyms, sports halls, and locker rooms must always be swept clean after use.

31. You are not permitted to wear clothing or use equipment that could cause damage to the sports facility, its equipment, or people present at the facility.

32. The use of equipment and materials is at your own risk.

33. Used sports and game equipment must be returned to the locations indicated on the floor plans or photos displayed in the storage areas, or, if those are not available, to the spot where they were originally found.

34. If spectators are admitted, the operator is responsible for Health sufficient and adequate supervision.

35. Changing rooms and shower facilities may be used 15 minutes before and 15 minutes after the reserved time for the sports facilities (this does not apply to consecutive bookings).

36. If there is no other use of the facility besides the sports hall, the catering facilities and the facility as a whole may be used for up to 1 hour after the end of the activity. In this situation, the user is requested to vacate the building no later than 1 hour after the end of the rental period.

37. Loitering in or near the changing rooms and shower areas without a valid reason is not permitted.

Dukdalf and De Meander Swimming Pools

38. When using the swimming pool, the user must provide supervision and ensure that at least one person present holds a valid first aid and lifeguard certification.

39. Wearing so-called outdoor shoes (without protective covers) in the swimming area is not permitted.

40. Running in the swimming pool area is not permitted.

41. Fragile items are not permitted in the swimming pool area or changing rooms.

42. Children who do not have a swimming certificate must wear water wings (at the discretion of the authorized staff) and must be accompanied at all times by an adult who is at least 18 years old and holds a swimming certificate when entering the swimming area. They are not permitted to enter the various pools without being accompanied by this adult.

43. You are not permitted to remain in or near the changing rooms and shower areas without a valid reason.

BRES Theater and De Man

44. The user is not permitted to enter the control room, the walkways, the dressing rooms, or the backstage area behind the stage without the permission of the venue operator.

45. The user is only permitted to use the freight elevator in BRES when instructed to do so by a staff member on duty.

46. The seating in the theater auditorium must never be moved or extended by the user. This must be agreed upon in advance with the venue operator.

47. If the user wishes to have a technician operate the lighting and sound equipment, one may be hired from the provider. The user is prohibited from operating the lighting and sound equipment themselves.

48. There is a refrigerator stocked with soft drinks in the technical room, as the technician is not allowed to leave the technical room during a performance. Any soft drinks consumed from this refrigerator by a (contracted) technician will be charged to the user.

49. Use of the coat check is mandatory when attending a performance in the theater, as required by the fire department. For your own safety, coats are not permitted in the theater. The coat check is unattended.

50. You are not permitted to bring food or drinks into the theater

't Dijckhuis

51. Use of the coat check at ’t Dijckhuis is required by the fire department.

52. The ventilation grilles in the various rooms may only be operated by the Site Manager of ’t Dijckhuis, unless the Site Manager has expressly authorized the tenant to operate them.

53. The public storage area may only be used by users who have received explicit permission from the provider. Users must store their materials there in an efficient and orderly manner and ensure that the storage area remains tidy at all times.

54. Standard room layouts apply to the rooms. When a room is put into use, the applicable layout is determined. This standard layout is set up in advance and will not be adjusted even if there are fewer visitors or participants.

Reede and Tromp Gymnasium

55. In the case of key rental, where the accommodation is made available to the occupant without an employee being present, the occupant will be provided with the key(s) to the accommodation, possibly upon payment of a security deposit, at the discretion of the lessor. The amount of the security deposit is specified in the usage agreement. A signature is required upon receipt of this key.

56. In the event of loss, misplacement, or theft of the key(s) provided, the Lessee must notify the Lessor immediately, and the security deposit will be forfeited. The Lessee is liable for any damages incurred by the Lessor as a result of the loss, misplacement, or theft of the key.

57. Before departure, the occupant must ensure that all persons admitted by or on behalf of him have left the accommodation.

58. If the premises are not to be used immediately thereafter by a third party, the occupant must, after use, close the windows and doors, check all rooms for any persons left behind or trapped inside, turn off all lights, and securely lock the premises.

59. Health is Health opening and closing the windows, doors, and gates of the accommodation, as well as turning on and off the water, lighting, electricity, technical systems, and alarm systems.

60. Any costs associated with failing to secure the premises properly or securing them incorrectly, or with failing to turn off or improperly turning off the water and electricity, the technical systems, and the alarm systems—such as costs related to alarm responses—shall be borne by the occupant.

Final Provisions

61. In the event that one or more of these provisions are violated, the staff member on duty is authorized to intervene, if necessary to order the person concerned to leave the premises and to file a report with the police.
62. The latter will always occur in cases of discrimination, vandalism, acts of violence, theft, and drug use. 
63. The staff member designated by the property owner has the right, where appropriate, to grant an exemption from the house rules and Requirements to deviate from them, with the exception of the provisions set forth in paragraph 62.
