Citation by the municipality

The municipality makes sure everyone follows the rules. So do the police.

If you violate legal rules, the municipality asks you by letter to undo the violation. This is called an injunction.

What violations is the municipality paying attention to?

  • building without an environmental permit
  • use of land and buildings in violation of the rules of the zoning plan
  • illegal keeping of animals
  • Offering garbage the wrong way

What should I do?

If you violate a legal rule, the municipality will send you a letter. In it they ask you to undo the violation (a writ of summons). If you do not agree, you must explain why. This is called an opinion. Send this opinion to the municipality.

Then you will receive a final decision from the municipality. In it, the municipality again asks you to undo the violation. This is called a final enforcement decision. Do you disagree with this decision? Then you can object within 6 weeks. However, you must already undo the violation.

Administrative coercion or penalty avoided

  • You can ask the judge for a preliminary ruling. You can only do this if you have objected.
  • You can ask for a postponement. The municipality will then do nothing until it has decided on your objection.

Violation by someone else

If you want the municipality to do something about a violation by someone else, report it to the municipality (this is called a request for enforcement). You can immediately ask the municipality to send a notice to this person.

How does it work?

If you do nothing, the municipality will take care of it for you, and the costs will be yours. This is called administrative coercion. The municipality can also make you pay a penalty. This means you must pay if you do not undo the violation in time.
