Buying, renting or leasing land

The municipality owns pieces of land in the municipality. Sometimes you can buy, rent or lease a piece of land from the municipality. For example, building plots, agricultural land or green spaces.

By signing a purchase agreement, you become the owner of the land. If you are going to lease or rent then you may use the land. Land leasing is only possible if you want to use the land for agriculture.

How does it work?

  • You can buy land. The municipality decides how to sell the land. For example, by registering on a waiting list, drawing lots, or by letting you make an offer.
  • You can rent land. Then the rules from ordinary rental law apply.
  • You can lease land. This land or part of it is intended for agriculture.

Building on land

You cannot just start building on the land. Requirements apply:

  • The zoning plan states that construction is allowed on the land.
  • You have an environmental permit to build.
  • You own the land or have a superficies or long leases on the land.
  • You must have a building plan that meets the Requirements of the zoning plan. The building plan must also comply with any adopted visual quality plan and other building regulations.

If you do not own the land and you also do not have a superficies or ground lease, then you must seek permission from the owner to build on the land. The landowner then also becomes the owner of the structure.

What should I do?

You investigate whether you can use the piece of land you want to buy, rent or lease for your purpose:

  • See what zoning the land has. You can do this through the omgevingswet website.
  • Find out what you can and cannot do with the land. This can be found in a Land Registry Notice property. You can order this notice from the Kadaster.

Difference between rent and leasehold

Land that is leased may only be used for agriculture. A lease agreement, in many cases, must be approved by the Land Chamber. A lease agreement does not. A lease is for a definite period of time. A lease can also be for an indefinite period of time.

Soil pollution

Before purchasing the land, it must be clear whether the soil is contaminated. The seller must inform you about this. A soil test will show if the soil is contaminated. Therefore, always have a soil test done first.
