An operating agreement is an agreement between the municipality and developers, construction companies or housing cooperatives. The agreement regulates the costs of providing public facilities.
The municipality is responsible for the construction of public facilities, such as sewers, roads and lighting. It is also responsible for preparing the land for construction and/or residential purposes. When building a new neighborhood, for example, the municipality must incur costs for these facilities. These are recovered from the operators of the land.
Cost sharing can be arranged before the exploitation plan is adopted. This can be done in an anterior exploitation agreement. If the parties cannot reach an agreement, the municipality must include an exploitation plan in the zoning plan, in which the division of costs is still regulated.
The municipality can also enter into an exploitation agreement after drawing up an exploitation plan. There is then a posterior exploitation agreement. In that case the municipality is bound by the exploitation plan when making agreements.
